These Terms of Service (“Terms”) govern your access
to and use of the websites, pages, content, and services operated by the
National Wilderness Leadership Institute (“NWLI,” “we,” “us,”
or “our”) that link to these Terms (collectively, the “Site”). By
accessing or using the Site, you agree to be bound by these Terms and our
Privacy Policy. If you do not agree, do not use the Site.
1) Who We Are & How to Contact Us
NWLI provides outdoor, wilderness, and leadership education
programs and related resources. For questions about these Terms or the Site,

2) Eligibility
You must be at least the age of majority in your place of
residence (or have parent/guardian consent) to use the Site. If you use the
Site on behalf of an organization, you represent that you are authorized to
accept these Terms on its behalf.
3) Changes to the Terms
We may update these Terms from time to time. The “Last
Updated” date reflects the most recent changes. Continued use of the Site after
an update constitutes acceptance of the revised Terms.
4) Your Privacy
Your use of the Site is also governed by our Privacy Policy,
which explains what information we collect, how we use it, and your choices. In
particular, NWLI may collect contact information (e.g., phone numbers) to
provide essential class information and follow-up, and students may request
corrections or opt out of non‑essential messages as described there.
5) Accounts, Security & Communications
Security. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use.
Communications. By providing contact information, you agree that we may send you service-related communications (e.g., schedule updates, location changes, weather adjustments, pre‑course instructions, and post‑class follow‑up). You may opt out of non‑essential messages as described in our Privacy Policy.
6) Acceptable Use
Violate any applicable law or regulation;
Infringe or misappropriate others’ intellectual property, privacy, or publicity rights;
Upload, post, transmit, or otherwise make available content that is unlawful, harmful, deceptive, defamatory, harassing, hateful, discriminatory, or otherwise objectionable;
Interfere with or disrupt the Site or servers (e.g., introducing viruses, bots, or scrapers, attempting unauthorized access, or overloading infrastructure);
Use the Site to send unsolicited or unauthorized advertising or spam;
Reverse engineer, decompile, or attempt to derive the Site’s source code except as permitted by law.
We may monitor compliance and enforce these Terms, but we
make no promise to do so and assume no liability for not doing so.
7) User Content
- Ownership. You retain ownership of
any content you submit, post, or upload to the Site (“User Content”).
- License to NWLI. By providing User Content, you grant NWLI a worldwide, non‑exclusive, royalty‑free, transferable, and sublicensable license to use, reproduce, display, perform, adapt, modify (for formatting), distribute, and otherwise exploit your User Content in connection with operating, improving, and promoting the Site and our programs.
- Your Responsibilities. You represent and warrant that you have the rights necessary to grant the above license and that your User Content complies with these Terms and applicable law.
- Feedback. If you provide feedback or suggestions, we may use them without restriction or compensation.
8) Intellectual Property
The Site and all content, features, and functionality
(including text, graphics, logos, icons, images, software, and the compilation
thereof) are owned by or licensed to NWLI and are protected by intellectual
property laws. Except as expressly permitted, you may not copy, reproduce,
distribute, modify, or create derivative works based on the Site or its content
without our prior written consent.
9) Third‑Party Links & Services
The Site may link to third‑party websites, services, or
resources that are not owned or controlled by NWLI. We are not responsible for
the content, policies, or practices of any third parties, and your use of such
sites or services is at your own risk and subject to their terms.
10) Program Registrations, Payments & Refunds (If
Applicable)
If the Site enables you to register for classes, make
payments, or purchase products:
Payments. You authorize us (and our payment processors) to charge your selected payment method for amounts due, including taxes and fees.
Cancellations & Refunds. Any cancellation, transfer, or refund policies will be presented at checkout or in the program description and form part of these Terms.
Accountability. You are responsible for any fees or penalties arising from inaccurate information or failed payments.

11) Risk Notice for Outdoor & Wilderness Activities
Participation in outdoor and wilderness education involves
inherent risks, including but not limited to environmental hazards, weather,
terrain, wildlife, and physical exertion. Where applicable, you agree to follow
all instructions, safety rules, and eligibility requirements for participation
in any NWLI program you register for. Some activities may require separate
waivers or assumption-of-risk agreements.
12) Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS
AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT
NOT LIMITED TO WARRANTIES OF TITLE, NON‑INFRINGEMENT, MERCHANTABILITY, AND
FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SITE WILL BE
UNINTERRUPTED, SECURE, OR ERROR‑FREE, OR THAT DEFECTS WILL BE CORRECTED.
13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NWLI AND ITS
OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS WILL NOT BE LIABLE FOR ANY
INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES,
OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR
ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A)
YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE; (B) ANY
CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; OR (C) UNAUTHORIZED ACCESS,
USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. OUR TOTAL LIABILITY FOR
ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US
$100) OR THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING
THE EVENT GIVING RISE TO THE CLAIM—WHICHEVER IS GREATER.
14) Indemnification
You agree to indemnify, defend, and hold harmless NWLI and
its officers, directors, employees, agents, and partners from and against any
claims, liabilities, damages, losses, and expenses (including reasonable
attorneys’ fees) arising out of or in any way connected with your access to or
use of the Site, your User Content, or your violation of these Terms or
applicable law.
15) Suspension & Termination
We may suspend or terminate your access to the Site (in
whole or in part) at any time, with or without notice, for any reason,
including if we believe you have violated these Terms or applicable law. Upon
termination, the rights granted to you under these Terms will end immediately,
except for provisions that by their nature should survive (e.g., intellectual
property, disclaimers, limitations of liability, indemnification, governing
law, dispute resolution).
16) Governing Law & Venue
Any dispute, claim, or legal action arising out of or
relating to:
your program registration,
your payment(s), or
any NWLI services provided,
shall be resolved exclusively in:
the United States District Court for the Eastern District of Virginia, Alexandria Division.
registering, participants consent to the personal
jurisdiction, venue, and authority of these courts.
Participants further agree not to contest
jurisdiction or venue and waive any argument that these courts constitute an
inconvenient forum.
17) Export & Geographic Restrictions
You may not use or export the Site in violation of U.S.
export laws and regulations or other applicable laws. Access to the Site may
not be legal by certain persons or in certain countries; you access the Site on
your own initiative and are responsible for compliance with local laws.
18) Entire Agreement
These Terms, together with any additional policies or terms
referenced or presented within the Site (including our Privacy Policy),
constitute the entire agreement between you and NWLI regarding the Site and
supersede prior or contemporaneous agreements on the subject matter.
19) Severability & Waiver
If any provision of these Terms is held invalid or
unenforceable, that provision will be enforced to the maximum extent
permissible and the remaining provisions will remain in full force and effect.
Our failure to enforce any right or provision will not be deemed a waiver of
such right or provision.
